Terms and Conditions
LIABILITY You agree that SV Patagonia and its owners, partners, agents, employees (including guides and other staff), and business affiliates (collectively “SV PATAGONIA”) is not responsible for any injury, loss, or damage to person or property, death, delay or inconvenience in connections with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of god, strikes or other labor activities, mechanical or other failure of airplanes or others means of transportation or for any failure of any transportation mechanism to arrive or depart timely, danger associated with animals, dangerous incident to activities such as trekking, rock climbing, ice climbing, , hiking, bicycling, illness, lack of or access to or quality of medical care, difficulty in medical centers, or any other cause beyond the direct control of SV PATAGONIA.
In addition, you understand that trekking and climbing in Patagonia is a challenging and potentially dangerous venture, thus you hereby release SV PATAGONIA from any negligence and you assume all risk.
CANCELLATIONS Upon written notice of cancellation (with email confirmation from SV PATAGONIA), the following terms will apply: Upon reservation until 90 days prior to departure -$500 USD non-refundable. 90 days t0 45 days prior to departure – $700 USD non-refundable. Less than 45 days, no refunds. It is your responsibility to ensure you receive confirmation from SV PATAGONIA in order to cancel your adventure. SV PATAGONIA is available by email and telephone. Without proper notice of cancellation, SV PATAGONIA will continue to plan your adventure as you requested.
REFUNDS After 30 days before your trip, and throughout the duration of your trip, no refunds will be given for unused services.
INSURANCE SV PATAGONIA does not provide or include accident or travel insurance policy in the expedition cost. You agree to obtain your own travel and accident insurance.
RESPONSIBILITY SV PATAGONIA assumes no liability for any type of injury, damage, loss, accident, social-political disturbances, natural phenomena or anything beyond our control. Reasonable changes in the itinerary may be made where deemed advisable for the comfort and well being of passengers.
You agree that SV PATAGONIA is not liable for provision of medical care. Climbers and trekkers assume responsibility for selecting an adventure according to their capability and experience, informing SV PATAGONIA of their abilities and bringing appropriate personal equipment, without jeopardizing his/her safety and the safety of the group. Our staff and guides are ready to advise you and answer your questions prior and during adventures.
OUR SERVICES DO NOT INCLUDE
- Flight to Santiago and internal flight to Punta Arenas or Puerto Natales, Chile
- Guide Gratuity
- All personal trekking, climbing and camping equipment, unless stated in your final agreement with SV PATAGONIA
- Accident and rescue insurance
- Cash for extra expenses
- Dinner and extra meals outside of the Park/trek
- Porter for carrying personal gear for clients (if you need a personal porter ask us (available at an additional cost))
VIDEO AND/OR PHOTOGRAPHY SV PATAGONIA reserves the right to take video and photographs during the adventure and reserves the right to use the photography for commercial, advertising, and/or promotional purposes. Thus, any copyright on material taken by SV PATAGONIA is its own intellectual property. By participating in an adventure with SV PATAGONIA, you agree, authorize and release the use of your image, voice and likeness in such photography or video. If you object to the use of your image, voice, or likeness in any video or photography, it is your responsibility to communicate this objection to your guide at the beginning of the adventure.
OTHER ITEMS SV PATAGONIA reserves the right to disqualify you or any person on the adventure at any time if SV PATAGONIA feels the person is mentally or physically incapable of continuing and/or if a your continued participation poses a potential risk to the group’s or his own safety. You agree and understand that SV PATAGONIA does not issue refunds under these unlikely circumstances.
Hospital facilities for serious problems are often difficult to reach in a timely manner, and in the event of illness or injury, evacuation can be lengthy, difficult and expensive. You acknowledge that SV PATAGONIA assumes no liability regarding provision of medical care. By hiring SV PATAGONIA and/or signing this Liability Release and Assumption of Risk Agreement, you agree to pay for your own emergency evacuation and emergency medical care.
VOLUNTARY PARTICIPANT You are aware and agree that you are a voluntarily participating in the adventure or trip.
AGREEMENT I have read and agree to all of the above stated terms and conditions. By sending my deposit, I am agreeing to these conditions and I also agree that I will sign this agreement and deliver the agreement to SV PATAGONIA before the start of my adventure.
